An Increase in Crime During the Holidays.

The holiday season seems to create more crime.  Maybe you needed extra money for presents or you just felt a sense of hopelessness at this time of year.  Needless to say this season comes with an excess of DUI’s as well.   A combination of celebration and seasonal depression can lead to a spike around the holidays, but the result is the same if you find yourself facing a DUI charge.

In San Jose, if you are arrested for a criminal DUI, there are certain steps you can take to help avoid a conviction.  Everyone knows that driving a vehicle under the influence carries serious consequences.  The authorities do not care that you were celebrating a company party.

The first step is consulting with San Jose Criminal Defense Attorney, William Chestnut. His extensive legal experience and familiarity with the process will be vital to your criminal defense.  You must never face this alone.  Call Attorney Bill Chestnut today at (408) 298-6990.

Can My Felony Charge Be Reduced?

When you are charged and especially convicted of a felony it can set you back for the rest of your life.  It effects your job seeking, your relationship building, and even potentially your housing choices.  You are aware that in this day and age there is ALWAYS a way to find out your criminal record when someone is vetting you.

The good news is that there IS a way to reduce the damaging effects of a criminal conviction.  Most misdemeanors and felonies can be cleared in state court.  Were you aware of that?  If it is a more serious matter you may be able to turn to Certificates of Rehabilitation.  In California we have one of the most “pardoning” governors in the country.

Hope is not lost.  There is a San Jose Criminal attorney who has had 3 decades of experience in matters of expungement and rehabilitation.  That man is William Chestnut.  He will help you repair your life after a felony conviction.  Give Attorney Chestnut a call today at (408) 298-6990.  Discuss your particular situation with him and he will begin the process of trying to find a solution.

The Ramifications of a DUI

What are the financial, lifestyle, and legal ramifications of a DUI?  Assuming it is a first–time offense and there are no additional charges or aggravating circumstances, you should prepare for the following:

1. Your driver’s license will be suspended for 30 days and you will be faced with administrative fees to the DMV to have it reinstated.

2. You will be ordered to pay a fine up to $1000 plus court costs and administrative fees.

3. You will receive a jail sentence of two days to six months, or community service if you are lucky.

4. You will be ordered to attend DUI School which you would have to pay for.

This is just part of the nightmare of getting a DUI.  Good people sometimes make bad decisions.  You have put yourself and others in jeopardy, but you should be able to get on with your life.  To make sure of that outcome, please call San Jose DUI attorney William Chestnut at (408) 298-6990.  Bill has defended thousands of clients for over 30 years.  Trust him to handle your case efficiently and aggressively.

October is Domestic Violence Awareness Month

Domestic violence counts on silence from the perpetrator as well as the victim.  This is the time when silence is not an option, nor is it an option to stand by when someone may be falsely accused of a domestic violence crime.  Everyone wants to end this pervasive problem, and some will go as far as trumping up charges to eliminate someone from their lives.

We all need to be vigilant and look for the signs of domestic violence in our home and the homes of our friends and relatives.  It is important to attempt to have a rational and meaningful discussion about the issue before any accusations are thrown about.  False or exaggerated reports of violence within the household occur every day.

If you have been accused of domestic violence please take immediate, but unemotional action.  Contact San Jose Criminal Defense Attorney William Chestnut.  Attorney Chestnut represents people throughout Santa Clara County, San Mateo County, Alameda County, Silicon Valley, and the South Bay area.  For any criminal matter call William Chestnut today at (408) 298-6990.

Domestic Violence in California

California has increased its efforts to curb domestic violence.  Recent efforts have included requiring arrests, increased prosecution, and tougher sentences.  Some of these new tougher policies can lead to overcharging and unfair convictions.  Sometimes the best solution is NOT criminal punishment, but rather constructive rehabilitation within the family unit.

If you or a loved one have been charged with domestic violence or assault, it is essential to hire a defense attorney who will listen to your side of the story and make sure your rights are protected.  San Jose criminal defense attorney William Chestnut has been protecting the rights of the accused for more than 3 decades and has defended thousands of clients over that time.

Attorney Chestnut provides powerful criminal defense representation for clients throughout Santa Clara County, San Mateo County, Alameda County, Silicon Valley and the South Bay Area who are facing charges of domestic violence.  Among those charges are: excessive force, assault, kidnapping, making terrorist threats, attempting to sway a witness, and much more.  Do not waste another minute, call Attorney William Chestnut at (408) 298-6990.
