Defining Environmental Crime.

Just a handful of years ago environmentalists, government agencies, and environmental attorneys were still grappling with how to define exactly what was an environmental crime, what actions should be prosecuted, and what penalties were considered appropriate.  In the late 20th century it mostly defined polluting the water or contaminating the air.

Rather than calling all environmental crime white-collar crime, law professionals tried to develop a better definition. Some of the factors are: (1) the harm done, whether the action caused harm immediately or was only potentially harmful; (2) the action itself, ranging from littering to major dumping of hazardous wastes; and, (3) the offender, whether individual or corporation.

Robbery Comes in All Shapes and Sizes.

There are about as many different types of robbery as there are shoe sizes!  Let me give you a for instance.  Let’s say the owner of a boat may take it to a marina to have it fixed. Once the work has been completed, the owner retrieves the boat without paying the bill.  However, robbery often includes force…so what type of robbery is this?

Redefining Drug Possession in California.

It is a brave new world out there Mr. Huxley.  Pot is now legal in our state.  Some are saying hallelujah while others exclaim oh no!  Proposition 64 is over 60 pages in length.  Make no mistake about it, you could still be arrested for the illegal use of marijuana in this state.  You need to know some of the facts.

Here are several…

1.  You have to be over 21.
2.  Don’t think that you can light up wherever you feel like it.
3.  You will be fined for smoking in public.
4.  If you want to sell it, you will need a state license.
5.  Selling pot without a license could easily result in fines and incarceration.

When things Go South Quickly.

Maybe it starts with a disagreement.  Perhaps it was pre-determined.  Whatever the case may be, when you or a loved one is arrested for an alleged violent crime all bets are off.  The situation just got real!  Make no mistake about it, if you are convicted for committing a violent crime, things will never be the same again.

Defining Fraud.

Here is a white-collar crime with a number of different meanings attached to it.  Specifically, criminal fraud involves using a lie, deception, falsehood, or dishonesty in an attempt to gain a benefit.  Fraud can also be a civil wrong-doing meaning that victims can bring a civil lawsuit for money damages, to fairly compensate them for the losses they suffered as a result of the fraud.

Types of fraud in California may include –

1.  Computer or internet fraud…a growth industry for sure!
2.  Benefits.  Someone has been arrested for dipping into a company’s benefits program.
3.  Welfare.  It is very common as people on the edge try to “get an edge”.
4.  Workers’ comp.  Obviously, there are many who may have exaggerated their claims.

Plenty of Sex Offense in the News these Days.

What on earth is going on here?  I suppose where there is smoke there is fire.  However, where there is smoke there is often time someone holding a lighter.  In other words, many of these charges involving celebrities accused of sexual harassment lately may be true or false.  Only time will tell.
